All terms in these General Terms and Conditions expressed in the singular include the plural and vice versa.
All terms in these General Terms and Conditions expressed in the masculine gender include other genders and are mutually applicable in other cases.
'Contract' represents any written or orally concluded contract (including contracts concluded by conclusive actions) between Barrage and the Client.
'Conclusive action' represents any action from which the intention of the other contracting party can be clearly interpreted, e.g. acceptance of the offer, acceptance of delivery, payment of invoices, delivery of the service order by the Client, use of the service, etc.
'Product' represents Barrage's own products or other products sold by Barrage as a distributor or retailer, regardless of the fact of the actual manufacturer, whether software, hardware or any third form of materialized or immaterialized items that may be traded in legal transactions.
'Service' represents all services from the portfolio of registered activities of Barrage in the relevant court register.
'Data' is a fact presented in a formalized form, e.g. as a number, word or image, but also includes personal data according to the GDPR, or other facts, regardless of the form in which they are presented.
'Price' represents the agreed price, and when such is not agreed, the usual price will be applied according to the standard price list attached to these General Terms and Conditions.
'Standard' price list represents the price list attached to these General Terms and Conditions.
'Emergency' represents a situation where a product implemented or a service provided by Barrage ceases to function as intended, if the domain is unavailable, if users of the Client's services cannot access the services online and if the product or service endangers or disrupts Client's other products or services.
'Force' majeure represents, in law, unforeseeable circumstances that prevent a party from fulfilling a contract and includes all actions beyond the control of any of the parties, which may include, but are not limited to: pandemics, fires, earthquakes, states of war (declared or undeclared), acts of terrorism, floods, storms, extreme weather events, etc., which Barrage could not have foreseen at the time of the conclusion of the contract, as well as avoided or eliminated.
